Why "Defenders" Fail
California's public defense system is chronically underfunded. Public defenders carry caseloads 2-3x the recommended maximum. But underfunding is not an excuse for every failure on this list. Some attorneys don't file motions. Some don't visit clients. Some waive rights without consent. Some don't investigate evidence that proves innocence. When your attorney is working against your interests — intentionally or through neglect — the system isn't just broken. It's complicit.
